If the termination of an employee is because they didn’t respond to progressive discipline or a performance improvement plan, then there is no obligation on the part of the employer to continue to carry the employee in the “spirit of the season.” An automatic moratorium on necessary personnel changes during the holidays isn’t “just business.” It’s bad business.
